Introduction

By using Online Farm Trials (OFT, www.farmtrials.com.au) and the content available on and through it, you are agreeing to the following Terms of Use.

Users agree they are aware that data and other information available on OFT:

  • may not be accurate, current or complete;
  • is subject to change without notice;
  • is frequently being validated, enhanced and updated, and
  • is subject to the usual uncertainties of scientific research.

The data and information accessed through OFT may also be subject to Terms of Use specified by the Trial Contributor, in which case the Terms of Use of a Trial Contributor take precedence over other information provided on OFT. The Terms of Use for a Trial Contributor or for OFT may change without notice.

Key principles of use of OFT that are acknowledged by Trial Contributors include that:

  • Trial Project data and other information submitted to OFT remains the property of the Trial Contributor, and that the Trial Contributor retains full editorial control of their content and publication of information on OFT, and
  • OFT metadata (e.g. Trial Contributors, Researcher(s) and Funding sources) will be displayed and maintained to the best possible standard within the limits of information provided for all Trial Projects submitted to OFT.

 

Terminology

Online Farm Trials: a web-based information system that provides open and free access to agricultural-based research trial data and information. OFT is a digital online resource managed through a collaboration between the Grains Research and Development Corporation (GRDC) and the Centre for eResearch and Digital Innovation (CeRDI) at Federation University Australia (FedUni).

Trial Contributor: an individual or organisation (e.g. grower group, research centre, commercial entity or government department) that makes data and/or other information available through OFT.

Metadata: information about Trial Projects submitted to OFT (e.g. names of the Trial Contributors, Trial Project title, Trial site location, Crop type(s), Growing season year(s), Trial type and Trial design). This data is compiled by OFT from information submitted with Trial Projects.

Trial project data and information: any attachment (documents and other files, e.g. PDFs, photos, videos, maps, reports and data files) submitted to OFT by Trial Contributors.

User/you: the user of OFT.

The content on OFT is provided for information purposes only. By accessing the website, you accept responsibility for assessing the accuracy of the data and information it contains. No responsibility will be accepted for any loss or damage, however caused, which you may directly or indirectly suffer in connection with your use of OFT, nor will any responsibility be accepted for any such loss arising out of your use of, or reliance on, information contained on or accessed through OFT.

Individual Trial Projects may also be subject to separate and specific disclaimers, which should be adhered to.

Use of information

In using OFT you recognise that:

  • content is protected by copyright, and some information may include specific licensing terms (e.g. Creative Commons) detailing how information can be used;

and agree that you will:

  • adhere to licensing conditions; and
  • comply with OFT Terms of Use except where Trial Contributor Terms of Use exist.

The use of information on OFT is the same whether it has been accessed directly (via www.farmtrials.com.au) or through other websites into which OFT has been embedded.

Plant Breeders’ Rights (PBR)

Some crop varieties used in research trials may be covered by Plant Breeders’ Rights (PBR). Users should confirm PBR status of relevant varieties by searching the IP Australia PBR database, http://pericles.ipaustralia.gov.au/pbr_db/ or Variety Central (http://varietycentral.com.au/) and contacting variety owners for further information if required. Where possible, varieties have been listed according to their registered PBR name, although OFT cannot and does not guarantee that the information is accurate or complete.

Note that PBR cover is administered through the Plant Breeders’ Right Act 1994 (https://www.legislation.gov.au/Series/C2004A04783).

Registered products, trade names and intellectual property protection

Products such as chemicals and fertilisers used in field trials may have registered trade names patents and other intellectual property (IP) protection. Brand names may also be protected. The IP Australia trademarks register can be used to check the status of each product or brand (https://search.ipaustralia.gov.au/trademarks/search/quick) and product owners should be contacted for further information if required. If further queries exist, contact the Australian Pesticides and Veterinary Medicines Authority (https://apvma.gov.au/).

OFT accepts no responsibility for the data and information contained in Trial projects, nor does it endorse any organisation or company linked to or associated with unregistered pesticides or other unregistered products.

Linked websites

OFT contain links to other websites: these are provided for convenience only and may not remain current or be maintained. OFT is not responsible for the content or privacy practices associated with linked websites.

Connections of OFT to linked websites should not be viewed as an endorsement, approval, recommendation or preference for the owners or operators of the linked websites, or for any information, graphics, materials, products or services referred to on the linked websites.

Security of information

OFT recognises that no data transmission over the internet can be guaranteed as totally secure. OFT strives to protect all such information but does not warrant and cannot ensure the security of any information that you transmit to us. Accordingly, any information is transmitted at your own risk. Once OFT receives your transmission, all reasonable steps are taken to preserve the security of information.

Data and systems integrity

By using OFT, you acknowledge that OFT is not responsible for any corruption or failed transmission of any information attributable to your computer system or to the system or any act or omission of your internet service provider. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the service or this site. You also acknowledge that access to the OFT may:

  • not be continuous, uninterrupted or secure always; and
  • be interfered with by factors or circumstances outside OFT’s control.

Citations

OFT and/or Trial Contributors (and, where applicable, partner organisations and researchers) are to be referenced or cited according to the licensing conditions specified for a Trial project by the Trial Contributor or by OFT.
